From the examination of the five
employees, in case the employees face any layoffs, they are protected by the
federal employment law in different ways.
In the case of Emma Connor, she is
protected under Title 1 and Title V of the Americans with Disability act of
1990 (US DoL, 2017). Laying-off Emma because of the short-term disability tends
to be protected under federal employment law that prohibits employee
discrimination against those with a disability.
In the case of Ron Johnson who is 49
years old, he had a heart attack, but despite being healthy, he has high
chances of suffering other chronic illnesses. In this case, any layoff of Ron
tends to be protected by federal employment under the Age Discrimination in
Employment Act of 1967. Under the act, it does protect the workers who are 40
years and older (Berreiro & Guerin 2016).
Jose Hernandez is 31 years old working
in the accounting department while his husband works in the marketing
department. A layoff of Jose can be protected by the 1964 Civil Rights act,
which is a law that protects the workplace rights of LGBT employees. Jose can
claim that his lay off was discrimination based on sexual orientation, which is
protected by the act.
Julie had an accident that left her
disabled and paraplegic. In this case, she is protected by the federal law
based on Title I and Title II of American with disability act (DeZube 2017).
The act prohibits discrimination against any qualified individuals with a
disability in employment.
In the case of Bobby Hayden, a layoff of
the employee is protected under the Civil Rights Act of 1964 that does prohibit
employment discrimination by public and private employers based on religion,
color, sex, or even national origin.
